Can a roofer waive your insurance deductible in Texas?

No. The Texas Department of Insurance (TDI) explains the rules: under Business & Commerce Code section 27.02, a contractor may not waive, rebate or absorb your deductible. You pay it.

If your contract is for $1,000 or more and is tied to an insurance settlement, TDI says it must include a notice that you must pay the deductible. Be careful with any "we cover your deductible" offer.

Can a roofer handle your insurance claim for you?

Not if the roofer is also doing the work. Under Insurance Code section 4102.163, a contractor who does, or may do, the work on your property may not act as a public insurance adjuster on that claim, and may not advertise that service. TDI notes that a website counts as advertising.

In practice, TDI lists these as things a roofer may not do:

  • Offer to negotiate your claim settlement or file the claim for you.
  • Promise to recover "every dime" from your insurer.
  • Tell your insurer that they represent you or speak for you on coverage.
  • Offer to waive, rebate or absorb your deductible.

The claim is between you and your insurer. If your insurer asks for proof that you paid your deductible, keep your receipt.

Who do you report a problem to?

TDI points homeowners with a concern to the Texas Attorney General at 800-621-0508. For insurance questions, call TDI at 800-252-3439.
